Need Help


I live in Michigan, and this past weekend a summons server came to my house, to serve a summons on me, I was gone, and was left a phone number to call. I know what it was about, MBNA Bank is trying to collect on a bill I owe, which I know I owe, but I do not work at the present time, I have a disabled husband who was sick this past summer, and is still trying to get better, I need to know what could happen to us, this bill was made before I met him or even knew him, I do not feel it is right for my hubby to be named in this at all since he did not sign anything. I also need to know what can happen to me with this lawsuit, please I need an answer right away.

Your husband is not responsible for the debt. His wages cannot be garnished and he cannot be sued.

You can be sued. Your wages can be garnished. Any bank account with your name on it can be seized by the creditor (but only after a judgment is awarded).

If you own a home, your share of the home can be attached by a judgment creditor. Likewise, an auto that has your name on the title can be attached (but creditors generally don't go after autos unless you have a lot of equity in the auto.
