Need Help Please


What is the name of your state? VA

History - My husband and I found ourselves in bad financial shape and decided to go with a debt settlement company. This was in November. So far the company has done fine for us. All bills were current until we went into this program. This decision was made in a desperate attempt to avoid bankruptcy. Our only concern being that we have 3 children and don't want to lose our home or cars(needed to get to work). We live a modest lifestyle. We just made some bad judgement calls and the situtation kept getting worse.

Problem at Hand- Yesterday, I got a warrant in debt from one of the creditors we have in the program. We go to court 1/18/08. Now I am scared to death. What can they do to us? Will they take our wages? How about our tax refund? What about the house and stuff? Also, there is something about homestead exemption waived and the yes box is checked. What does that mean? What should I take to court with me?

Any advice or information will be greatly appreciated.

The best thing you can do for youself right now is find out what your rights are. Please see:

It's a harsh reality but there are very very few debt relief agencies out there that can help. Most hinder and get you into this kind of trouble. They mis-inform you of your rights and neglect to inform you that they can't shield you from this kind of thing. Some lie and tell you they can.

In your shoes, I would call this agency and demand my money back with a full accounting of how badly they have messed up the accounts I entrusted with them. I would file a complain with the FTC and your state's Attorney General about them as well.

Check out the web site I have listed. The information listed will help you Answer your summons. Also see if you can find links so that you can submit Exemptions paperwork.

Know your rights and defend yourself! Good luck - I know it really sucks to have this happen over the holidays.
