| | | Need Some Adivce What is the name of your state (only U.S. law)? California
When I was with my ex we got credit cards in my name because he had no credit. I was only 18 and since he was 25 I trusted him. First off I moved in with him and he knew I was going to go put an application in for a company I had worked at prior to moving. Then his moms car he was using died, so he asked if he could use mine so he could get to work. I was using a car that was in my name and my step-dads. My parents paid the insurance on it. He told me he had a redistricted license, when he knew he didn't even have one. My step-dad allowed him to use it to go to work. After living a month with he's mom we moved into our own apartment, that was co-signed by my grandma. Also I renewed my grandmas cell phone plan so he could have a cell phone.
Anyways, the credit cards got racked up to the limit on everyone of the 6 credit cards bringing my debt to almost $9,250 @ 18 years old. I broke up with him but had a contract that he was to pay for the cash advances, purchases, phone bill and then the money would go toward the grill($350), computer(almost $1500), and the monitor($450). Also if at anytime he stopped paying that I had the right to confiscate the computer, monitor, and grill. He signed the contract knowing what the balance was. Also I had two witness sign it too, my brother and his fiance. He paid for 4 months and then stopped paying and then the next time he did start paying all the money went toward his phone bill. One month he took it over $300. I want to know if I have any legal right to take the grill, computer, and monitor? Also can I take him to court for the other money owed?
Another question would be can he take me to court for not paying rent or any of the bills? We lived in a 2bd/2ba that for the first 8 months his family lived in the spare room not paying anything and then my brother and his fiance moved in once his family was out but paid $300 in rent and bought their own food. I did bring some money in. He asked me to move in with him knowing I didn't have a job since I was moving from and hour and half away. He didn't say anything then. I had no issue working, I actually like working. When he did tell me to look for a job I told him I would need my car and he told me to ride the bus. In Modesto and I'm a 18 year old girl. I told him to take the bus if he wasn't scared and he said no. I cooked for him. Plus he used my care everyday he had to work only changing the oil and air filter once and replacing the water pump when it went out. He also paid for gas, but that was it. This is the kind of drama that can be expected when two people decide to play "house."
You can sue him up to the statutory limit in California. Since the bills are in your name, you will be held solely responsible for paying them back.
