Need time sensitive advise...please reply...What is the name of your state? Az My understanding is the SOL start at the time the account became delinquent. So I pull the credit report and looking for Discover. Discover is no where to be found on the credit report. However the CA that bought the account is on there in discovers place and it only shows the debt is a couple years old. How do I found the original credit history. |

SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.) Disputes: You can write a letter of dispute to the three credit reporting agencies. | Ok the long story... I submitted an answer stating the account was past it SOL for Arizona that is three. This is atleast 4 years old. However I just got notice that the judge granted a summary judgement for the plantiff. I dont even get my day in court????? So I look at another one of my cases for another credit card, same SOL defense and I see a different judge in the same court house denied the summary judgement due to the SOL being expired. I started to think how could this be? So I pull the credit report and discover is not on there. If they supplied a history on their own it could only show back as far as they had the account which is only about a year. I want to fight the judgement, with the actually date it started to be past due or even charged off. Could this be their way of re-aging the account? |
