What is the name of your state (only U.S. law)? Pennsylvania
Im being sued by Atlantic credit for a credit card charge off they bought. I sent out a request for verification but they haven't sent it. Instead they have begun to sue. If I can prove they received my request, can I move to dismiss?

nope, thats what a summons is for... you go into court to state why you don't owe the money, they go into court with proof that you owe the money.

The reason you would send out a request for verification is to ensure that you are the correct person who owes the debt, that the amount to be collected is appropriate, and that the collector is able to collect that debt.

If you had happened to send out the verification request within the 30 day period after initial notification you would have enjoyed being free from continued collection activity until they verified the debt.

However filing a lawsuit is not collection activity. You enjoy a different method of finding this info out altogether when embroiled in a lawsuit - that is called "discovery".

As the other responses indicated, you made a very expensive error listening to Buddy boy hibbs.

If you sent the letter you got off of his site, you didn't send validation, you sent a cease and desist. And you got sued.
