Is it legal for a private collection agency to put a garnish on boyfriends wages for his girlfriends medical bills?
She had filled out a routine Dr.'s questionaire and stated as a emergency contact her husband and name and number**************************** But they are not legally married. The collection agency is claiming since she put him down then he is liable as well. Hell she should have put down Bill Gates and maybe she wouldn't be in this situation.

This sounds Bizzare. Do they have a judgment against boyfriend? If so on what grounds?
Did he sign the questionare as the responsible party for payment.? Was he served with a summons to go to court?

Not unless he signed to be financially responsible for the bill !

The collection agency is claiming since she put him down then he is liable as well.
That is a crock of you-know-what ! Emergency contacts can NOT be held liable for someone else's medical bills !

They can't garnish ANYTHING w/o having a judgment first, so girlfriend needs to get a copy of the judgment case file for the lawsuit. Boyfriend needs to IMMEDIATELY APPEAL the garnishment since it's not legal.

Typically, the Court will not allow a garnishment without a judgment as garnishment is one of the "remedies" the law provides to satisfy judgments.

So, she identified him as her husband.

But they are not legally married.
Well, being that husbands are generally liable for a wife's medical debts, the CA went after the debtor's self-identified "husband". It is not unreasonable to rely on such information to be accurate. She complicated matters by lying. One can only hope she didn't complicate matters further by committing insurance fraud.
