notice to appear for pretrial conferenceWhat is the name of your state? florida I received a summon to appear for a pre trial. A collection agency wants to sue me for a credit card debt . According to them I owe some $ amount , the credit card was delinquent in 2001, last activity/last payment was june 2001, charged off november 2001. They bought the account in 2004. Did the statute of limitations expire? is it legal what they are trying to sue me in court? what should I do? Your advice and help is appreciated. |

| While CCs are usually considered open accounts, they have many times now, been argued successfully in court as written contracts, the SOL in Florida for an open account is 4 years, and a written is 5 years, so yes either way, you are still within the SOL, and they can sue you.
