| But the SOL in Tennessee is 6 years. It's not clear from your post, but you may have an affirmative defense, if they sue. You don't say whether "they" is the original creditor or a collection agency. At this time, I know of no court decisions that unequivocally state that it's a FDCPA violation or a violation of Tennessee law, if a creditor or collector pursues recovery on a time-barred debt. |
