Paid invoice, now roofer wants more.


What is the name of your state (only U.S. law)? I'm in Florida

In May of 2007 I requested an estimate for a shingle roof and a steel roof on my house. I accepted the steel roof and 4 months later they completed the job after many headaches.

I had to actually make multiple attempts for them to bill me and pay for some damage that was done during the installation. I discussed the bill with the owner on two occasions. The final bill had the deductions for the damage, but the invoiced price was considerably lower than the original estimate for the roof. I paid the amount owed and received a receipt stating paid in full for a steel roof.

I was recently contacted by the owner of the company and he says I still owe them between 6 and 7 thousand dollars. The actual amount was not given to me over the phone. He told me his secretary made a mistake over a year ago and charged me for the shingle roof instead of steel.

I told him I would need to check my documents and he asked that I call him the following week. I called him the following week, but he was not available. I left a message with the secretary.

He did not call me back, but I did receive a letter from his attorney stating I owe $6590, plus legal fees. If I don't pay in 30 days I will be turned over to a collections agency.

I contacted the attorney to let him know that I have not received a call from the roofer and that I have never received an invoice for any outstanding balance. The attorney stated he would forward me the bill, but that has not happened. I've attempted to contact the attorney two more times, but he is not returning my calls. At this point I'm not contacting the owner of the roofing company.

After reviewing the original estimate it is apparent that I was billed incorrectly. I'm curious if I'm required to pay at this point since it has been over a year, it was their mistake and I have a receipt stating paid in full for a steel roof.

Does your response mean that I'm not going to be responsible for additional payment since I have a receipt stating paid in full for a steel roof?

I can't or won't say that you are or are not legally responsible. I will say that if that debt was placed with my agency and you sent us a copy of the letter stating you were paid in full, we would return the account to the OC as previously paid.
