Question

Paid one price, now the store wants more


What is the name of your state? Pennsylvania
I purchased a rifle from a gun shop. At the time of purchase I paid the verbally quoted price. I took the rifle with me and a few weeks later, I recieved a letter stating that the shop had made a mistake and charged me the wrong price and that they wanted me to pay the difference back to them. Upon the advise of others I was told not to worry about the letter. Last week I recieved a lay-a-way notice from the gun shop stating that I had a remaining balance (the price difference). This week I have recieved a notice that they are taking me to a small claims court (local magistrate) to collect the difference. I can't see how they can possibly have a case against me. I'm looking for some advice if anyone has anything to offer.

Why didn't you call them and discuss the problem after you got the first letter?

So you don't have a bill of sale I take it? Not good. Perhaps request a full refund and return it... who wants to purchase anything from an unorganized business?

Make attempts to keep this out of court and document everything very specifically. If it does go to small claims, you'll be seen as a person trying to clear up the mess.

I have a reciept that lists the stock number of the rifle and has the price of $450. There was another slip from the store that the guy used to write down my personal information in order to call in for the registration permit. He had written down a price of $980. After he ran my credit card, he stapled that slip to my receipt and stuck them all in gun case. I talked to the guy on the phone, but his attitude was not pleasant and wanted all or nothing. I would have negotiated an amount since the mistake was made on their end (which they admitted in the letter they sent).

It doesn't say "Paid in full" / "as-is" or "$XX.XX amount due"? Guess I am a bit confused whether or not this receipt could be construed as a lay-away purchase and the salesman thinks you still owe monies?

I can't give much advice, but I would think having a bill of sale completes the sale. Perhaps they are trying to give a scare tactic? Do you have the firearms in your possession? Would you be willing to give it back for a refund.?

i suggest you contact your states Dept of Consumer Affairs...has helped us in many situations....they may be able to help you clear this up or advise you whom may be able to help....this sounds a little complicated so please hang on to all letters,receipts etc. ..appears to me that THEY made a mistake and now want you to pay for their mistake..but then again i dont know all the details....

I think returning it doesn't sound like a bad idea, personally.
