Papers Served on Hospital Debt Included in Bankruptcy


What is the name of your state (only U.S. law)? GA

I was serve papers yesterday on two hospital bills that were included in bankruptcy. Bankruptcy was filed July 2007 and was completed October 2007. Why did I get these papers and what do I need to do now that I have been served? Do I contact the lawyers via registered letter stating that my obligation to these debts were terminated with the bankruptcy or do I wait for the court date?

Contact the lawyer who handled your bk immediately.

If you have the paperwork to prove that this debt was discharged in BK, show up in court and raise that defense. You will probably win if this is the case.

all you need to make sure that these are the same hospital bills that were included in the bk call up the atty tell them you were discharged 07 etc etc etc any competent atty will have pacer to check and you'd be in the clear

Thank you....But Worse Case


What if it turns out that these were not included for some reason? After speaking with my BK Att and if I find out that these are different billings what are my options. Can I just pay the amount? Who do I pay...the att or the court? Can I pay without going to court?

Did you file Chapter 7 or 13 bankruptcy? If chapter 7, was it a no-asset or an asset case?

It was a chapter 7...not sure what you mean by "no-asset or an asset case"?

OK...I did some research about asset and non-asset and the bankruptcy was a non-asset. There was nothing liquidated and sold to be paid to any of the creditors. So now if for some reason these were not included in the paperwork then it is possible that with the discharge these are also no longer my responsibility?

If the debt was incured prior to your bk filing, it was discharged and you have no liability. If it was post petition debt, you are responible.
Look at your creditors matrix and see if the creditor was listed.
