parents getting sued on vehicle voluntarily repossesed


What is the name of your state? Texas


I am in need of some help, my dad had signed for a vehicle to help my brother out. My brother came into a slump and couldn't pay the car note my parents tried to make the note for him but got to the point where they couldn't make the payment any longer. They contacted the bank it was financed through and voluntarily asked to come and pick it up because they couldn't make payment on it any longer. After calling for 5 months to come and pick the vehicle it finally was picked up.
Now my dad received a citation for a law suit against him on this vehicle. It's asking to file a written answer with the clerk who issued this citation. I'm trying to help and I know my parents do not have the money to pay for a lawyer and even to pay for this.

My question is what do i put in the letter and since this is written off on his credit report what is the SOL on this issue? It's been written off as of May of 03.

Any help would be so appreciated.

I believe it's 4 years. When was the Complaint filed?

Well, April 03 is before May 03, thus, there's probably no valid SoL defense. Doesn't hurt to plead it anyway - just in case.
