Payday Advance CollectionWhat is the name of your state? South Carolina I had taken out two payday advance loans via personal check in the amount of $345.00 each and lost my job one week after taking the loans out. I will start collecting unemployment within two weeks from today to start paying them back with. The debt is 2 months old and I recieved a call from a collection agency representing them telling me to have my lawyer to contact them. I believe that this is a scare tactic but not sure of it. Is there a time limit (30,60,90 days) that the collection agency has to wait before filing suit? What are the consequences (jail time, penalties, etc) that I will face under SC law if I am sued for this debt? |

| The comment is intended to intimidate. That being said, if the debt is in default even by 1 day, they are free to sue. There is not way to guess how long they will let this ride. You will not be arrested and will not go to jail for the debt. Debtor's prison was abandoned shortly after the Civil War. Often a Sheriff's Deputy will serve the summons if you are sued. But all the wants to do is give you a piece of paper so he can go on to the next one. These companies are predators of the worst sort. You need to do what it takes to pay them off and swear to never again use them. Otherwise, they will eventually own your soul. |
