Since December 2015 I have been receiving emails from a collection company's legal advisers stating that they represent speedy cash. The email has logo and they claim that I owe a past due loan from 2014 for the amount of $640. I am currently a customer and do have an open loan with the company as of December 2015. I started to receive the emails around the same time I reopened my loan with the company. This morning I was contacted by a company who claims they are legal advisers for Speedy Cash in regards to the same loan that I allegedly owe. They have threaten legal action and have stated that I will be served at my home tomorrow with legal documents from them stating that I am being charged with not paying this loan, intending to defraud the company, and 2 other legal charges. According to the individual I spoke to over the phone I am being sued for $3157.00 on the loan I allegedly owe. He was willing to settle out of court for about $1300.00. I informed him that I do not have that kind of money to pay he stated that he could work out a payment plan and gave me two options 1) 2 payments of $675 or 2) 1 payment of $975. I told him I could not afford that and if he was willing to work with me I could do much lower payments until my debt with paid off. He stated that the loan I was being sued over was from August 6, 2014 and it was a 30 day loan that was to be paid back on September 6, 2014 and was not paid and sent into collections. The individual also claimed that the loan was taken out threw yes payday.com which is an online lender which now operates under speedy cash. I asked the individual who he was actually representing he stated speedy cash. I told him that I found it interesting that I was able to re-open up a loan with speedy cash even though I owed them money because from my understanding the company will not approve my application. The individual stated that many companies send off outstanding loans to collections but they will allow you still re-borrow even if you owe them. I asked him if there were any other options for repayment and he hung up on me. Two hours later I received another phone call from a phone number with all zeros same as this morning from a young lady stating that I needed to contact the same number in regards to a legal matter and legal documents. After the initial conversation with the individual named "James" I contacted speedy cash to verify the alleged past due loan I am being "sued" for. I was assisted by one of the reps who by the way was extremely helpful and understanding of the situation. I explained the whole thing to her and she was able to verify that I do not owe the company any loan from 2014. She verified that I never took a loan in August 2014 nor September 2014. She also verified that I have never had a 30 day loan with the company. I also informed her that the individual stated that speedy cash once operated under yes payday. She also confirmed that if I did have any previous outstanding loans with the company that were in collections and the company will not allow a loan application to even process and advise me to file a police report. Am out in the Los Angeles area, Can I really be sued by these individuals for something I don't owe?

Yes, you can be sued. It doesn't mean they'll win, but they can certainly sue you.
