Payment Arrangement with Debt Collector


What is the name of your state? Virginia

I made an agreement with a collection agency to pay off my debt. I was only obligated to pay off half if I paid a certain amount up front, then $452.20 on the 7th of each month for six months until August 7, 2006. I had the amount automatically withdrawn from my credit card account each month. On the 6th month, I received a letter from the collection agency stating they did not receive my payment and, therefore, the payment arrangement is no longer valid. When I checked my credit card statement, it showed that the collection agency withdrew my final payment on August 8th, not the 7th. Am I held liable since we made an automatic payment arrangement and it was the collection agency who chose not to withdraw the money until the 8th? It's very suspicious that they diligently withdrew the amount on the 7th each month until the final month, when they waited until the 8th. If anyone can tell me whether or not I have a case here, I'd greatly appreciate it.

Oh you bet it is !!!! If you think for 1 minute they didn't do this ON PURPOSE you're dreaming, especially since 8/7 was a MONDAY.

Did you have this 'agreement' IN WRITING ??? If not.. and you did it all over the phone, then there was no agreement and they scammed you - big time.
