Personal Credit Card loan collectable?


What is the name of your state?CA

If a person uses their VISA card to make purchases for you - then files personal bankruptcy (liquidation) and has all of their VISA debt erased, can they go after you for the VISA purchases that they made for you? It seems like unjustly enrichment.

If you owe someone money and they file bankruptcy do you still have to pay them?

Hi Debtcollector. Keep in mind that cash wasn't rendered. The VISA card was used for each transaction, and now the VISA card debt was wiped out in Bankruptcy court.

The bankruptcy only eliminated the cardholders legal obligation to VISA. If you had an agreement to repay the person that used the credit card, the bankruptcy DOES NOT remove your legal obligation to repay the person. If you don't want to repay the person, you will have to file bankruptcy and list this person as a creditor. The unjust enrichment goes both ways too, you are getting use out of the purchases that were paid for by the bank that issued the credit card. Talk about calling the kettle black.

To put it simply - the bk "erased" their debt - not yours.
