please clear up a question.


What is the name of your state? Illinois
I basically have a hypothetical question. I have heard a story of a car being repossessed for failure to pay for some type of title fee. It was said $175.00 was owed for this. All other principle and interest had been paid in full and this was supposedly the only money owed. I was always under the impression that the vehicle was collateral for the principle and interest. I realize they could do anything they want but is it legal to repossess for fee's owed other than for p & I? I have researched the laws but could not find a clear answer. I really would appreciate the answer or directions on where I could find it.

Is it because this is basically a hypothetical why I am not receiving an answer? I heard this from a repo company and wondered if it was legal. I would really like to know what the vehicle is collateral for. Please at least steer me where I can find the answer.

Look it up in the archives. Do your homework -- most of us barely have time to help the people with real situations.

I did look it up. I could not find a definitive answer. This was not totally hypothetical. My cousin's car was repoed unjustly. She sent in the final payment but they did not cash it for 47 days. They said she was in default and came and got it. I just assumed that since this is like the third question I have asked in 2 years, and some seem to find time to be rude and sarcastic to some on here, that I might get a little help. I do appreciate you taking the time to read this post. Have a great day and take care.

I'm not sure of hte laws regarding repossession -- it is an area I don't deal in personally. I would say that if she paid the car off and it was repossessed something is wrong here. Either the car wasn't paid off, or the correct term is stolen.

She needs to do several things here:
1. go over all of her payments and make sure none were returned NSF.
2. Contact the BBB and see if there are other cmplaints against this dealer/finance company.
3. Talk to a lawyer and see about filing an injunction stopping them from re-selling or auctioning her car until the legal questions here are resolved.


Is it possible that your cousin fibbed to you about making the payments on time? I deal with debtors every day and most tell stories -- especially to people they don't want to be embarrassed in front of.

I appreciate your time. We went through everything.Somethings just not right with the loan company. She retained an attorney today to help her. Thanks for the response. I didn't think they could do that.
