Please help.


What is the name of your state? NY

Today my employer received a subpoena with restraining notice and questionnaire regarding a credit card dept I never paid. I’m having financial difficulties since September 11 and I cannot afford to pay this dep. I have three questions regarding this mater.

1. If I go with the option of bankruptcy, would this dept go away?

2. What are the next steps the attorneys who are suing me would take
after my employer send this paper work to them

3. I currently paying child support, are these attorneys entitle to 25% of my salary also.

It looks like they aren't suing you, but sued you already. Now they have a judgment against you and are trying to get the money taken out of your pay. Did you ever get a summons to appear in court?

Yes, I did get a summons to appear in court and I did go to court and filed the paper work to make payments. I also made several payments for a few months but after 9/11 I lost my job and I was unable to make payments.

Your best bet would be to negotiate more affordable payments with them. The law says your employer has 7 days to reply to that information subpeona and after that, they are probably going to be taking the money from your check.
You can try the bankruptcy route, but that takes time and money as well. Which it sounds like you have neither right now. Try to negotiate with them.

One more question.

How the garnish is calculated for this credit card debt, I’m asking because I already pay garnish for child support.
