Please help..collection agency trying to collect debt that has been paid off in full.


What is the name of your state?NY

The other day I saw that my checking and savings account had been frozen, and today I recieved a letter from my bank with relative documents from a law firm called Wolpoff and Abramson trying to collect a debt that I have paid off to a different collection law firm that was collecting this debt. I have saved all the photo copies of the letters, including the paid in full letter and copy of the cashed check to the first law firm. The first law firm even wrote the initials PIF on the check when depositing the check (which I asume is paid in Full).The first lawfirm was Mel S harris and assoc.

My question is : What is my next step???
With whom do I get in contact about this??

Disputes: You can write a letter of dispute to the three credit reporting agencies.

Sometimes errors are easy to remove and sometimes they stick like glue. It is inexpensive to try and not difficult.

I also just filed complaints with the credit bureaus online..I hope this helps also as the credit report wasnt showing paid in full.

Another question.....Do I get in contact with this new Collection agency and tell them that it is already paid off in full?

The full payment was made to the first collection agency on Feb 11th using the paid in full letter...How long does it it take for the CA to report the debt paid off to the bureaus?...Im just lost right now on what my next step should be and mad that another CA is coming after me for the same debt and using the same judgement.

Wait a minute.. W&A can NOT freeze your bank account without a valid judgment against you FIRST ! You apparently HAVE been SUED and lost, otherwise Wolpoff would NOT be able to do this.

Were you ever served with a summons ?
Did you get ANY communications indicating you were being sued ??

If not, then you need to call or go to the courthouse and get a copy of the judgment case file ASAP.

Sounds like you have adequate proof that you paid in full, but lawsuits don't happen overnight. You need to appeal the bank levy with the court IMMEDIATELY, then contact the scum at W&A and get this worked out - including getting the judgment vacated.

thanks for the response lady :-)**************Well I did have a judgement against me from 2002 which the first CA used against me. I then paid them in full and kept all copies of my letters and the cashed check etc. On my credit report there is only the one judgement from 2002. I havent been served with summons from W&A, only today I got a letter from the bank saying that W&A are freezing my account for the same debt that I have already paid off. So I should go to the court first and file a motion to vacate?....thanks again

Actually, what you need is a letter of satisfaction from the FIRST CA, the one you paid in full for the judgment. Sounds like W&A may have purchased the judgment, but have no clue that the judgment has been satisfied. That's why you MUST appeal the bank levy, they can't nail you twice for the same judgment. The pay-off of the judgment has to be recorded with the court to close it out. The letter you have may be sufficient, but you need to find out...and you need to move to stop Wolpoff immediately.

Do what Lady says - I live in NY too**************...... had my account frozen

The other thing I'd advise in the mean time to is STOP all regular deposits that you can ASAP - I mean payroll direct deposits, etc**************..

Because until this is cleared you will NO access to any monies in your bank account.

Make sure that you give copies only to the court and keep your own files maintained.- - don't let them have your papers because God forbid you ever need them again, you won't have the originals......
I'd also encourage you to forward a copy of that paid in full letter to all three credit reporting agencies**************.. Transunion, experian, and equifax......

Thanks for the advice everyone...I just got back from out of the country and will be following your advice...Ill keep you posted as to what goes on...thanks again
