Posting again. Debt collector withdrew money from frozen account, has not returned


What is the name of your state? NY

I am posting this again. SteveK said do not worry, I did not. But now it is time to do something, as I agreed in the court to pay $1,224 on January 1, 2005 for everything that MEL HARRIS (a debt collector and law firm as they say) was claiming which was $2,004.74.

They had put a levy on my bank account on October 1. On October 4 they have withdrawn $2,004.74 and on October 25 they have withdrawn 192.41, which is a total of $2,197.15, which is more than what they claimed, and much more than the amount we agreed on.

The court day was November 10, 2004. The Judge ordered the release of my bank account, as well as the return of the monies they had withdrawn. But I have not seen anything yet.

What should I do?. If they do not return this money, should I not pay the agreed amount amount on January 1st?.

Actually, what I believe I said is wait until the end of the first/second week of December, something to that effect. You've waited roughly four business days since you last asked the same question.

Draft a Letter to them, and attach a copy of the court's order instructing them to return the amount stated. Tell them you expect to receive that money within the next 10 days , and if they abide by the courts orders , you will abide by it as well. Tell them if they do not sent the court ordered amount back to you by the time you make your payment , you will deduct the amount owed to you out of it.

Incidentally, that extra $192 or so is probably the extra few days of interest, the marshall's statutory $15 fee and the poundage.

Update


I received a check of $2,077.53 from the City Marshal. I guess he liked the balance of $119.62. Is this his fee? The judge ordered for them to return all my money.
