| | Property Lien? I currently live in Texas. Over 5 years ago I had business in Oklahoma. I had some equipment on a lease with ORIX, with a $1 buyout at the end of the lease, which I did. Approximately 6 mos. after the buyout, I closed my business, sold the equipment and moved. As my luck would have it, I lost half of my papers in the move, including the lease buyout. Shortly thereafter, ORIX began calling , saying I still owed the final payment ($1,040). After countless arguments, they have since turned it to at least 4 different collection agencies over the last 5 years. I told them all "I don't owe it, I won't pay it". Today, I get a call from ORIX, with a lady telling me this is the last attempt, to reach an agreement, before they get a summary judgement in New York, and put a lien on my house. I said forget it. Is this possible? Thanks. |

Is this possible? Thanks. | No, in Texas your home is exempt from judgements such as this. The SOL for written contracts in the state of Oklahoma is 5 years, so if this debt is older than that, you don't have to pay. Send them a C&D letter by CRRRM. By the way, I'm sure they have to go by Oklahoma SOL since that is where the debt originated, but if they go by Texas, SOL is 4 years there. Either way, you don't have to pay.
