Property Lien?


I currently live in Texas. Over 5 years ago I had business in Oklahoma. I had some equipment on a lease with ORIX, with a $1 buyout at the end of the lease, which I did. Approximately 6 mos. after the buyout, I closed my business, sold the equipment and moved. As my luck would have it, I lost half of my papers in the move, including the lease buyout. Shortly thereafter, ORIX began calling , saying I still owed the final payment ($1,040). After countless arguments, they have since turned it to at least 4 different collection agencies over the last 5 years. I told them all "I don't owe it, I won't pay it". Today, I get a call from ORIX, with a lady telling me this is the last attempt, to reach an agreement, before they get a summary judgement in New York, and put a lien on my house. I said forget it. Is this possible? Thanks.

No, in Texas your home is exempt from judgements such as this. The SOL for written contracts in the state of Oklahoma is 5 years, so if this debt is older than that, you don't have to pay. Send them a C&D letter by CRRRM. Below is a link with sample letters that will help. Good luck.

By the way, I'm sure they have to go by Oklahoma SOL since that is where the debt originated, but if they go by Texas, SOL is 4 years there. Either way, you don't have to pay.
