Property lien


In Missouri. I loaned a man $15,000 for his business. I have a Promissary Note against his business that he signed as President of the company. He had filed Bankrupt both personally and on his business before the transaction. My question is can I put a Lein against his property and how do I do that? I went to the Recorder of deeds office and they told me I had to have a Deed of trust signed by him. He is selling his house and I just want to make sure I get paid out of the money he gets. I also have a copy of his check showing he paid me $300.00 a year ago.

i believe you are going to have to get a judgement against him thru the courts. before you can enforce anything on him. If he is selling his house now, by the time you get a judgement you will probably have to go after his next house. Because it takes months to get a judgement.
