Protect husband or WifeWhat is the name of your state?What is the name of your state?Florida I sent a reply to the court for student loan defaulf offering $150 per month Bank debit, that's more than they will get from wage garnishment . Will they take that? My husband owns the house and everything in it, purchased before we were married what should he do to protect intrest. My car has his name on it (for 2 years) is there any way that they can take the car, it's paid off. and we have a 12 year old car for the teenager with just my name on it. Should I add his name to my checking account ? It's in the negative most of the time |

Its not his debt, they cannot touch anything that is in his name only. FL is NOT a community property state - what's his is his and what's yours is yours. With a wage garnishment they can take up to 25% of your pay, if the $150/mo is not equal to that, then they may not agree to your payment offering. Have you tried to consolidate or rehab these loans ???
