Question about Judgements


What is the name of your state? NJ

Lets say you file your answer 4 days before the deadline and then you receive a copy of the letter sent to the default claims department from the plantiffs attorney before the deadline, was the attorney assuming that the answer wouldn't be filed or am I missing something? shouldn't the plaintiffs letter to the courts go out on the date of the deadline and not before?

A. It should not be lodged with the Court until the day after the deadline has passed. If it wasn't, the attorney runs the risk that it will be rejected and in transit back to him/her, but it also may be that you miscalculated the deadline.

Thanks chein, It was not miscalculated, it clearly stated that it be filed within 35 days of April 3rd 2006, I went up to the intake office with her on May 5th 2006, the answer was dated May 5th, then she received the default letter from the plaintiffs attorney on May 6th 2006.
