Questions About A Bank Account Levy


What is the name of your state? TEXAS

Can anyone give me info on what happens if your bank or savings account gets levied. My main questions is do they have to file each time they levy or can they do the paperwork one time and the levy continues. If you lose your court case can they make you tell them your checking account number, or is it up to them to get that info on their own? Generally how long after losing the case do they wait before the levy the account?

Who knows how long it will take. You are not required to give your bank information, they will get it on their own.

That's correct. The courts & attorneys can find out anything they want. It is foolish to think you can hide monies and bank accounts from the courts. They will find it. A levy normally is placed very shortly after the Judgement is granted. For example- if you had a checking & savings in a Bank. Upon the courts obtaining your info, they would make a decision what account to levy, possibly both depending on the Judgement amount. Basically, they freeze the account, any monies in the account at the time is gone! You lost it basically! This can be done with wage attachment also. wage attachment is a little different. basically, the courts are freezing a percentage of your paycheck every pay period until the judgement is satisfied. This would cause most people some worry and embarrassment. Especially if your employer becomes involved (if they decide to levy your wages).

I don't think they can touch my wages by law in Texas. What about if you have a joint checking account or have your check deposited into someone else's account, can they still take the entire account. Also do they just take what's in the account at the time they file or can they take it more than once?

You are correct in that they can't garnish wages in Tx. except for court ordered child support, spousal maintenance, fed. & state taxes & personal injury/property damage. However, if they get a judgment against you, they can & will levy your checking/savings accounts. Since Tx. is a community property state, bank accts. under both names (husband/wife-joint accts.) might very well be levied also. They can take until they are paid in full.
