re-aging debt?JD from Indiana- I was contacted by Midland Credit two months ago saying I owed them $1700. I sent the ma debt validation letter via certified mail and I recieved confirmation they recieved it..It's been a month and I have not hear from them. I worked really hard getting everything removed and paid on my credit, for the last year and a half I have enjoyed being debt free, but this has srung up. I think this is something from like 8 years ago or longer and wasn't on my credit file any longer. I just checked my reports and all three say midland have me in collections for that amount as of last month. NOTE: I have not had a credit card or paid on a credit card since 2000, but this is showing up like brand new. 1. I'm about 99 percent sure this is like way old and not reportable any longer. 2. I sent 2 certified copies asking for debt validation to midland and still no response. I think they are avoiding me, b/c this is old debt and they don't want to give me the tools to prove this is past the SOL and federal debt reporting. 3. Where do I go from here? | Dispute it with all three credit agencies, Equifax, TransUnion and Experian, it's an old debt past the statute of limitations and they can no longer have any legal claim nor can they put it on your credit report. You can do the disputes on line with each of the credit bureuoes very quick and easy. No worries. Though the can still try to collect the debt, since it has passed your states statuets of limitations they have no legal recourse, hence that is why they haven't responded back. But it is up to you to dispute it though, they won't take it off unless they are told to. Odds are once you have done the disputing you won't hear from them again, they were taking a shot in the dark and hoping you weren't aware of your rights. |
