received summons no court information


What is the name of your state? MN
Received a summons from an attorney representing a Collection company that bought my debt. The summons has no Court Information on it or Case Number. It says I need to respond within 20days or a default judgement will be granted. It looks like a summons from what I have seen before but has no court information at all. It is only signed by the attorney. Is this legit or do they want to try to contact me first before filing a suit.

At this point it is unclear as to what the Attorney is doing. It is not unheard of for an attorney to do this as a threat to get you to pay and paperwork with no case # or court date is an indication of this. You can do a little leg work and find out!

Call your county's court house and ask the clerk there to look up the case by name. Has it been filed? If not, can you check back in a few days?

Have you ever talked to this attorney before, or did this incomplete summons arrive out of the blue? Did it come by mail, or was it delivered by a process server?

Ok, this is what I would do in your shoes.

For now lets assume it is real, regardless of not having a court date or docket number. Start doing some fact finding so you can prepare your Answer for the court.

As I said in my last post, keep checking with the court house. IF it turns out the Summons is filed, then by all means File/Mail your answer properly.

If after a few weeks go by, and nothing is filed - they have violated the law and you have great proof of them doing so in your hands. File a complaint with your Attorney General and send them a copy of the bogus Summons. If they keep violating your rights as a consumer, contant an attorney - a free consultation will let you know where you stand!

Thanks for the website never heard this before but this is what it said----
If it is District Court, the papers will come from the people suing you, or their lawyer. The papers won’t have a court date on them. (papers did have district court on it). Talking to a lawyer tomorrow on it.
