Remedial Validation question


What is the name of your state? California
Ok I know this has been covered a bunch of times but:

A CA told me tonite that they sent a debt collection letter with the proper validation notice under 809 (a) and (b) to an address that I didn't live at in 2003.

I have documented proof I was not living in that city during 2003 let alone that house. (I was in california).

He says case law is they only have to send it to last known address. THEREFORE automatic payday on ACCOUNT STATED the SOL is out the window.

Do I have to receive it? I mean if I wasn't living there what does it matter they they sent it?

And what pray tell, does 809(c) mean?
"The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer."
Anybody? (except resident board bully)

How long ago did you last pay the original creditor? Do you know if it's still within your state's statute of limitations?
