Rubin and Rothman


[font="Century Gothic"]What is the name of your state (only U.S. law)? NC but debt was obtained in NY. I had a car that was repossed on an old order. They took the car and wanted us to provided 3000 dollars to get it back with towing cost and storage, etc. Our note at the time was paid up. But because the amount was so much we couldn't afford to retrieve the vehicle. They sold the car for way less and they are now garnishing my husbands wages for the balance. In addition to this action, they have seized his bank account and my bank accout within a month of each other. They are also using two different collection agencies for the same account and there is a host of discrepancies on the amount due. What do i do to get some resolve in this matter. :confused

I work for a debt collection attorney and know rubin and rothmen very well probably the biggest debt collection attorneys in the state of new york... however im confused? you live in NC and your husband is having his wages garnished on a NYS judgment? thats impossible the only way that could have happened is if they sent the claim out to a NC Atty with a exemplified copy of the judgment and an action would have been refiled against you in NC... if you could clear up details I could help you more

What if the employer is located in NYS?

The employer is not involved until a 2nd stage income execution is issued, and that can not be done until after a 1st stage is completed. A first stage income ex is a voluntary payment of 10% of your gross paycheck which has to be served by the sherrif of the county that a judgment debtor resides in. So therefore, a NC sherrif does not have jurisdiction over transcripts of judgments from NYS
