Satute of Limitations on unpaid Bills!


What is the name of your state (only U.S. law)? Florida

I received a letter the other day from a Debt Collector stating I owe FPL (Florida Power and Light) some money (less than $350). This unpaid bill is from over 5-6 years ago. Has this unpaid bill met the Statute of Limitations for FL? or no. Also how can they come at me 6 years later and try to collect a debt? I thought I paid them off months after i was late on my payments with them, but all of a sudden 6 years later i get a letter saying I owe money, why didnt they contact me sooner?

If someone could answer my questions i would appreciate it greatly.

Okay I know in NY it's 6 years, if I am not mistaken in Florida the SOL is 5 years I believe and yes, they can come after you for the bill however long within that 5 years they want sometimes its 8 months other times like in your case its 4 1/2 years. Good thing though you live in a very debtor friendly state!

Yes, your mistaken. The SOL would be 4 years. OP, send a cease and desist letter.

would a power bill be considered an open ended account or a written contract? if it's a written contract the SOL is 5 years, open ended account the SOL is 4 years.

You need to remember that the power company holds a lot of, um, well, power over you. If you ever want to have your power turned on again, you are going to have to pay the bill regardless of SOL and the average annual rainfall in china.

Something you might want to think about.
