Sherman chapter 13 discharged

I had disputed this with Experian and they say it will remain on my credit report???

Do I need a Lawyer to get Sherman off of my Credit Report..

This is the response I had received from my chapter 13 lawyer..

"as long as the status shows that it was filed under Chapter 13, and as long as they aren't attempting to collect from you, there is nothing you can do. Chapter 13 does not wipe it off your credit report. It appears to be correctly reported."


I still feel this is wrong....
help is appreciated..

They are definately reporting incorrectly. You may just have a lazy lawyer.

Unless you opened up an installment loan with Sherman. That's what their entry is saying.

If your BK is discharged (?), and this debt was included (?), then there are many errors in the way these are showing that is making your credit appear worse.

Check out the credit forum on Creditboards.com. Tons of great info from people with lots of experience with this (and with Sherman, too).

I thought my lawyer was wrong..
Guess he is only good at banckrupty..

I knew it wasn't right!!!!

Sherman ALWAYS reports collections as 'installment loans'.. its a crock !

First of all, a discharged debt CANNOT be 'past due'
Second, the dates for your CH 13 are reported wrong on BOTH entries - dispute it

Thirdly - reporting to the credit bureaus IS considered 'collection activity' by the FTC.

Lastly, FDIC regs say the following:

6500 - FDIC Consumer Protection Section 607--Compliance Procedures 6. Content of Report

A consumer report need not be tailored to the user's needs. It may contain any information that is complete, accurate, and not obsolete on the consumer who is the subject of the report. A consumer report may include an account that was discharged in bankruptcy (as well as the bankruptcy itself), as long as it reports a zero balance due to reflect the fact that the consumer is no longer liable for the discharged debt. A consumer report may include a list of recipients of reports on the consumer who is the subject of the report.
They cannot be showing ANYTHING owing !

my question is.. should Sherman even be on my cr?
I never received anything at all from them..
Plus all debts were filed chapter 13 before it went to collection..

Sounds like the creditor sold off your accounts after you filed. Since reporting to the credit bureaus IS considered to be 'collection activity', then they may, in fact, have NO right to be on your reports if the debt was not in collections BEFORE you filed.

Dispute the entries, every wrong piece of them with the credit bureaus.
