SOL & C&D or DV? Geeze, 13 yr. old debt here!


What is the name of your state? Arizona

Yesterday, received a "letter" from Merchants Credit Guide Co.

Oh joy... what idjits!

They are attempting to collect on a 13 yr. old credit card that my husband had, and it went CO BEFORE DH & I got married in 1994!

That said, I really want to play with these guys and get them on violations and ITS them.

You see, I have PROOF that:

1. Florida Statute of Limitations: Title VIII, Chapter 95, Sec. 95.11 Oral Contracts; §95.11(3) Four (4) years from the date account would be cause of action to be delinquent. Any action on any debts, or alleged debts incurred while living I was living in the State of Florida will now be out of the Statute of Limitations for collection purposes.

2. Arizona Statute of Limitations: Article 3, 12-543 Oral debt, stated or open account; three (3) year limitation.

3. This debt was not on DH's CR when we applied for mortgage in June 2002 - if it was, we would have had to pay it.

4. This debt is not on the copy of DH's CR from June 2004, or Dec. 2004 - therefore, any attempt at putting this on his report by Merchants will be in violation and re-aging.

5. I have paperwork, all nice and neatly filed in 10 x 13 yellow envelopes dating back to 1996. Yeeeup, I am positively pathetic about keeping old statements for at least 10 years. Nuttin honey in there about this old account! *evil grin*


Now, I have also gone to EdCombs.com website - they are lawyers who specialize in Consumer Protection, and I *think* that they begin class action lawsuits against scum-sucking, bottom-feeding pond scum like Merchants. I will be writing out my cover letter and faxing this all to those attorneys today. (Combs is out of Illinois, same place as this Merchants).


SO.. question is.. how do I start letting them rack up violations. By being Ms. Dumb Schmuck Consumer?

Or, because I may just end up flubbing this all up - should I just send them:

-----> DV letter?

-----> SOL/C&D/GO-sit-on-a-sharp-stick-you-slimy-scum-sucking-waste-garbage-collectors? (sorry for the insult to garbage collectors!)


Please advise.. this stupid letter is dated 4/08/05 - funny, didn't get it until 4/20/05.... seems to me it doesn't take 12 days to get from IL to AZ, with my "30-day mini-miranda"!
