SOL on CC debt- getting sued


What is the name of your state?What is the name of your state? California

I am POTENTIALLY being sued by bank of america for a small credit card debt of $4400 that they now claim due to interest and fees is $6600. Regardless- the account was closed in Jan 2003. My Experian report reads "30 days as of Aug 2002, Dec 2001"
Does this mean my last payment was Dec 2001? If so will I have reached the SOL in CA as of Dec 1 this year?

Please help! Statute of Limitations in CA


I live in Los Angeles, California.

I posted earlier with no reply. Please help! I need to know if I have reached the statute of limitations for my debt. I know it is 4 years for a written contract. I believe my last payment was Dec '01. If so, will I have reached the SOL in the next couple of weeks? BofA is threatening to sue me.

Any advice will be greatly appreciated...

The SOl is 4 years, but based on that information, I would think that anyone here would be reluctant to tell you with certainty that the debt is time-barred at the end of December. You don't sound certain yourself.

If BofA is doing the collecting and it is the original creditor, it's not obliged to respond to a request for validation. I don't see that as a reason not to ask. If suit is POTENTIAL, I doubt that they're going to let the SOL slip past. If you owe the debt and can address the matter of payment, you might want to consider that in addition to counting down the days.
