SOL - Personal & CC debt - CALIFORNIAWhat is the name of your state? California I would really like to know what the SOL is on this type of debt. Situation: Owe too damn much, but NEVER SERVED FOR COLLECTION BY CREDITORS. Does that mean a judgement has not been filed? If a judgement has been filed, how can I find out? When, if ever, does this debt cease to exist? Thanks |

A judgement isn't filed. A suit is filed, and then a judgement may be awarded if the creditor wins their case. If a creditor is seeking a judgement they must notify you by mail. If they have your current address then you should have received a summons. Why don't you have any information about these debts?

| Hi Veronica: Guess I was being too vague. By Personal Dedt, I mean things similar to credit cards; i.e., purchase debts, money extended by a manufacturer, or their financial partner for a purchase. As for notifications, I haven't been anywhere near an address at which I could be notified for years now, approx. July 2002 or so. Basically, guess I'm wondering it it can go to suit or collection status without me personally having been served, but I gather from your reply, perhaps it can. Would the SOL start then or when I stopped paying? Not that I don't want to pay these debts, its just not practical or feasible at present and unfortunately, won't be any time soon. |
