Sol (so many conflicting answers)What is the name of your state?Illinois This is in addition to my last query "I recieived a summons" I have been scouring these boards all day trying to figure out the answer to this question but it seems there are many conflicting opinions. Can anyone point me to where I can find this info. please? My question is" Does the sol start from the day my CC account went delinquent and they cut off the credit (early 97), or from the day I made the last payment to them? (03) Thanks for any help. |

| Email Rich --- He really helped me or go on his website. Good Luck!!! California Statutes of Limitation Written agreements: 4 years, calculated from the date of breach. Oral agreements: 2 years. The statute of limitation is reset only if the debtor makes a payment on the account after the expiration of the applicable limitations period. Now, call or stop by the court that issued the judgment and get a copy of the records. I'll bet you were never properly notified of the court hearing and based on that file to have the judgment overturned. Consider contacting a consumer protection attorney. They usually work on contingency basis so it does not cost you anything. Respectfully, Rich Rafferty Rich's Enterprises raffman@knology.net www.fair-debt-collection.com |
