Spouse stole money - is hubby liable?


What is the name of your state? - Virginia

I know someone who spent $26,000 on the company credit card over a year and just got caught and fired. Her hubby is worried that the company can come after him legally and pursue him for the money (He didn't know she was doing it). The company wants the money in a month. They don't have a way to pay it back that quick unless they get a home equity loan, which he doesn't want to do (and rightly so) since she has gotten them into more debt than that. Does anyone know what legal rights the company has to pursue the husband?

The company has no recourse to sue the husband given the facts you have described.

That does not mean they cannot cause grief. The company will almost surely refer the matter to the police for criminal prosecution. Her assets can be attached to pay the judgment. I assume she is a joint owner of the home, car, bank account, etc. so things will get messy.

Both spouses need to consult an attorney.
