Spouses Debt - Harrasing me at work


What is the name of your state? Florida

Apparently my husband incurred several debts prior to our marriage. He was ill for over a year and defaulted on his credit cards. He has not been able to pay them back and since this is a new marriage, we have not had an opportunity to gather ourselves financially to pay back any of his debts. We got married on December 29, 2004. It will be 2 years in a few days. I understand that the debt they are calling on was incurred about 5 years ago. They have somehow found my work number and are constantly calling me about my husband's debt. This has caused a tremendous amount of embarrasment and I can't seem to get these people to stop. I would like to know if I am liable for my husband's debts prior to our marriage. If I am not, what recourse do I have to stop this harrasment. Thank you for your attention and time.

You should not be responsible for debts in your husband's name only. Is it the original creditor calling or a collection agency? If it is a coll. agcy., your husband can send them a cease & desist letter asking them not to contact him or his family anymore except to let him know what add'l. action they plan to take to collect on the debt. What was the last time your husband paid on these credit cards - I was thinking maybe the SOL has expired for coll. of the debt. It would be a defense to use in court if you get a summons to court.

Thank you Betty for your advice. I believe the SOL may not be applicable since we attempted to repay the loan back in July, 2006. I know now that I restarted the clock. I did send them a Cease and Desist letter by certified mail, r.r.r., we have to see if it works. The last call I got from them was on Thursday at work. Thanks again for your advice.
