Statute of LimitaionsWhat is the name of your state? Utah What is the statute of limitations on a BK reaffirmation agreement (from a credit card debt) signed in April 1998? No payments were ever made. Last edited by msm715; 01-10-2005 at 11:25 AM. |

| Well, it's either going to be 6 years (written agreement - which this may be since you signed a reaffirmation agreement) or 4 years (open ended - credit card). Did the judge sign off on the reaffirmation? |

| I did check and the agreement was filed with the court right before we received the discharge. We never heard from the collection attorney again until about 8 months ago when we began receiving billing statements. I was thinking the SOL was up so I never responded to them. They recently sent a letter asking me to call to resolve the matter along with a statement that unless I disputed the debt within 30 days they would assume it to be valid. |

| Send them a debt validation letter prior to the 30 days being up. Click here: http://www.creditinfocenter.com/rebuild/debt_validation.shtml |
