Statue of LimitationsWhat is the name of your state? Miss. Can someone tell me what the SOL for Ms. is? I have listened to Clark Howard on the radio and he says that some debts can't be collected after so many years. Is this true and what is the limit in Ms.? |

| In MS this is true ! SOL in MS is 3 years and state law even bars COLLECTION on a time-barred debt. Don't know who Clark Howard is, but in this case he's correct.

SolThank you for answering. So does this mean that when the CC company charged off my debt , that is when the clock started? Some have been picked up by a collection agency. Do they have a right to collect after this 3 yr period and can I just tell them to shove it? |

| The SOL started when the account first went delinquent and you never paid on it again.. or 30 days after your LAST payment to the original creditor. The SOL is not a barr to collection, so yes, they can keep trying to collect, but you can send a cease and desist to make them go away based on the expired SOL.
