What is the name of your state? arizona. i am being sued by
sherman and associated for a best buy credit card. i opened this
account in colorado. is is true that they have to abide by the statute of
limitation for the state of colorado or can they use arizonas statute
of limitation. and is it true that colorado is 3 years and arizona is 6.
if anyone can answer i would sure appreciate it. i have to answer the
summons and dont know if i should use that as my response. if not
i will have to file chapter 7 bk thanks so much and it has been
over 3 years since i used or paid on this account thanks

SOL for Colorado is 6 years.

Arizona is a little trickier. Technically, per Truth in Lending, CCs should be 3 years (open accounts). However I have heard, and I don't know if this is true, that Arizona is one of those states that the courts have been ruling that a credit card is a written contract, and therefore they are using the 6 year SOL.

Therefore, it will be the same either way.
