Stipulation of Dismissal

What is the name of your state (only U.S. law)? MA
Can a stipulation of dismissal be filed by the defendant, or does the defendant must wait until the Curt sets a motion to dismiss hearing?

I received a Stipulation of Dismissal by the plaintiff, however it reads without prejudice.

I would want this to read with prejudice.

Don't know if I can just make the change, pusuant to the provisions of rule 41(a)(1)(i)

or should I wait for the discovey compliance date to pass.

I am not an attorney so I could use your opinion.
