Stipulation of judgment agreed with citicards attorney, do I need to attend and OSC?What is the name of your state? CA I didnt know if this belongs in the credit cars area or debit collections so I posted it in both. I have a stipulation for judgment with Citibank's law office and have been making monthly payments. I checked the status of the case online and see there is a order to show cause hearing on 6/02/08. there is also a Case management conference 08/29/2011 (when the stipulation payments will be completed) I'm wondering if the OSC is offset since there is a stipulation and a CMC scheduled? Do I need to go to court for the OSC? I have tried all week to reach the credit card attorney office and haven't received a call back. |

| (It’s not appropriate to double post but, if both are ignored for that reason, you also don’t get an answer.) No, you don’t have to go to the OSC. That’s the plaintiff’s attorney’s responsibility. If you’re checking online, see if the Case Summary refers to a something like “Notice of Settlement filed”. If it does, the OSC would be vacated (taken off the court’s calendar - but only the attorney would have gotten notice of that). The OSC is to ensure that the case is proceeding as required. It’s the attorney’s responsibility to inform the court. If the attorney failed to do that, the court will take whatever action it considers appropriate against him/her. If there is a problem, it’s not yours to fix. |
