I escaped from an abusive relationship. we were living w/ a friend at the time. The ex moved all of my belongings to a storage facility under his name, sent me the info & the key a couple mo later...I've been struggling to pay this every month. A friend told me that the storage unit accepted stolen property and was keeping it from me because nothing in the unit belongs to the ex and they're suppose to give my stuff to me & sue my ex for payment. Can i legally fight to stop the storage co. from auctioning off my belongings?

How long have you been paying (or not paying) for storage?

If you have the key, why haven't you retrieved your belongings?

And, during those 2 months prior to him sending you the keys, why didn't you find a way of getting your stuff? For example, if you had some form of Order of Protection/Restraining Order, the party who moved out usually can make an arrangement to reenter the former home and retrieve belongings with some sort of law enforcement person overseeing/escorting. I'm being vague because you're being vague, and didn't even include your state.

During those 2 months you could have gone to court to request either the return of property or the fair value of the property (limited to property you can prove exists and is yours).

And how was the storage company supposed to know that the stuff your ex stored belonged to you and not him? It's not their job to make sure everything that gets stored with them belongs to the person renting the unit. Your friend is 100% wrong.
