stressed mom creditors attacking


What is the name of your state? Florida. A creditor called for my mother today. she purchased an organ . Since the hurricaine they have been showing up at her home unanounced and charging fifty dollars for each home visit.Today a creditor called me asking for my mother saying it was a criminal matter. Her told my father my mother was going to jail if she didn't settle this account with 23000. dollars. Is this true can they really put my mother in jail for a debt that she can't pay? She is seventy four years old and can't handle the constant strain they are placing on her.

What they are doing is illegal. No they cannot have your mother arrested. If I were you I would turn the basterd in. in my state it would be our attorney generals office. Have her write a letter ordering them to cease all contact with her.

Well, what they are doing may or may not be illegal.

First, if the creditor is the original creditor then they are not subject to the Fair Debt Collection Practices Act. So, a cease and desist letter is not going to help.

The charging $50 per visit sounds really fishy to me. But, it all depends on what the credit agreement says.

Unless they are violating some state law, there is not much you can do. A complaint to the State AG might help -- it will not hurt but it might not do anything.

No, they cannot put Mom in jail. They can sue her and obtain a judgment.

Does she really owe $23,000 on an organ?
