Student Loan Questions

Missouri

My husband owes a lot on student loans. Here are my questions:

1. If we are legally separated, does he need to add my income when consollidating under an income contingent loan plan? I know already that he doesn't have to if we are divorced, just wondering if the same rule applies to legal separation.

2. We will not be legally separted this year, but next--so if he applies in the next year, since they go off of tax records, will he still have to pay usiing my income, since we were married all of the last tax year (2008) ?
