Student Loan Wage Garnishment - Which State Rules Apply?


What is the name of your state (only U.S. law)?

I am a part-time Massachusetts/part-time Florida resident. My employer is based in Florida.

My federal and state taxes have been taken towards some of the debt.

I was contacted by a lawyer on behalf of my university for what they say are more federal loans. I have been trying to negotiate a settlement with them but don't know if I will be able to or not.

If court proceedings do come and let's say they order wage garnishment....which state laws would apply? Massachusetts or Florida (where my employer is based)? I know Florida has a "head of household" law which I am.

The state you are garnished in; that's whose laws will apply.

So would that be Florida? Since that is where the garnishment would have to take place.

Sorry ... but I have no inside info on what the plaintiff is going to do.
