Student Loans-Garnishment


What is the name of your state?What is the name of your state? California

I received an unmarketable degree from a very expensive private school. I now have a degree and work for $12/hr in Southern California. Needless to say, I am basically hand to mouth. I made payment arrangements on the debt, but it's mostly just for my peace of mind- I don't pay enough to make a dent in the debt. Well, they say I have failed to demonstrate financial hardship and they are going to begin garnishing 15% of my pay. This will kill us. Is there anything I can do?

File a lawsuit against your school. The first thing that they should teach incomping freshmen is "paying 100,000+ for a degree in English (or similar) is a waste of money"

But seriously. You were told that you didn't demonstrate financial hardship. What have you done to try and demonstrate that?

I filled out some paperwork they sent including an income/expense declaration. I requested a telephone hearing to go over the details and I was told they did not see a need for my requested hearing, they had made a judgement.

Financial hardships have two different meaning... The first meaning is what you think it is, which is this: I make 1000/month and my bills are 800/month. I am financially strapped.

The real meaning is what the school and the Federal Govt. use, which is this: You have to PROVE beyond a reasonable doubt that 1.) you will NEVER EVER be able to pay back your student loans, not even a dollar, and 2.) You will NEVER EVER be able to work for the rest of your life...

Since you CAN work, and you CAN make more money, you have failed to meet the requirements for "hardship"

Remember, no-one held a gun to your head forcing you to take the money and attend a private school... There are a lot of good Community Colleges out there for a fraction of the price...

Time to grow up and get a second job...
