What is the name of your state? Tx

Got served papers that I am being sued for default on account from collection agency that bought the deliquent account. Last contact was June of 2001. Date of papers served was yesterday 7/13/2005. Is the SOL 4 yrs and if so would that dismiss the suit?

Texas Statute of Limitations is 4 years.

The time counts from the date of first default -- which is generally 30 days after your last regular payment before the loan thereafter always delinquent.

When was the last payment made? Can you prove when the last payment was made?

Have you looked at your credit report to see what it says for date of last activity?
