Sued by LUVN FundingWhat is the name of your state? New York. Hello Please help. I recently run my credit report, and found a collection agency trying to collect $1,449.00 for me. I did what I read on this forum and ask for validation. I send them a certified mail (RRR). About two weeks later I receive a letter from them stating "I have not respond to the first letter, so I can't ask for validation now". I never receive a letter from them unlit I write to them and ask to validate the debt. A few days later, and this morning there's a summons pasted on my front door (two pages open flying around with everything open and there's tenant in and out of the house i am renting, and it was holding up with scotch tape. I grab my camera and take a picture of how it is before I picked it up. Is that a proper way to serve someone? They've ask me to answer the summons within 30 days. I am going to answer it because I don't know anything about this debt until I run my credit report. So for my case, I have a copy of the letter I sent asking them to validate it, the RRR, picture of how the left the summons scotch tape on my front door, and the letter they said I am only allowed to ask to validate it by the first letter they sent me after that I cannot ask to get it validate. (the letter of which I never received). I still haven't got any validation, which I'll ask for when I go to court. the thing is though. It says to go and see the court clerk before 30 days. So this is not my actual court date? |

| You are being sued. You need to answer the suit. I suggest you search here for pointers or go talk to a local attorney. DC

Here's what to doGo here. Read the sticky notes on how to respond. How old is the debt? Google your state's statute of limitations. What kind of evidence did they give. They are suing me too, and I'm going to beat them. [url]http://creditboards.com/forums/index.php?showforum=37[/url] |

They're on my credit report, too!But I've never had any dealings with MCI (who they are representing) ... and I've already disputed it with the credit bureaus. From what I've seen on websites like "RipoffReport.com" and the like, LVNV and MCI are both notorious for cheating people and running scams. Whattabunchajerks! ![]() |

| Disputing it on your credit report is not related to the litigation. As suggested by Debt Guy, you have to file an answer and defend the litigation. Don't confuse the two. |

| Oh, no, I realize that ... my point was simply that it's possible that the OP is in the same situation where he's being accused of a debt that's not his. I was just commiserating that I, too, am having bad dealings with LUVN! |
