Is suing CA worth my time?


What is the name of your state? AZ

I recieved a letter from Merchants' Credit Guide Co. I have never heard of the "original creditor" they have listed on the letter. I sent them a request for validation letter. I received the certified mail receipt on 5/15/07. I have received and documented at least four phone calls from them since then. On the unexpected chance that I receive a letter from them within the next four days, I have a cease and desist letter ready to send them. Can I, and is it worth my time, to sue them for the continued phone calls? The request for validation letter I sent them indicates that after receiving the letter they can only contact me by mail.What is the name of your state?

I am being called by Merchant Credit regularly every other day now. I would really like to take them to court. They only have until June 14th to validate this debt. Any input?

if you sent them a letter telling them not to contact you except by mail and you have proof of this and they have continued to call you, then, yes, they are in violation. keeo a record of the calls, the times and the names of the people. Then go for it.

HOWEVER, if you just want them to STOP CALLING, tell them when they call you and WARN them if they call again you will take them to court.

I can't remember the Small Claims in AZ (I Lived in Parker for a while), but if you are comfortable, you could sue them in Small Claims (FCRA states $1000 per violation - or something to that effect, google it!)

Yep. That is correct. I've collected a few CA's for violations. If they don't follow the laws then they will have to pay. But you better have your ducks in a row...
